Massachusetts Title 5 and Regulatory Matters

Massachusetts onsite sewage disposal systems are regulated by Title 5 of the State Environmental Code, including 310 CMR 15.000 and related MassDEP, local Board of Health, and approving authority requirements.

A Massachusetts Title 5 inspection is a regulatory inspection performed according to applicable requirements and available site conditions. A Title 5 inspection is not a warranty, guarantee, engineering design review, survey, environmental site assessment, subsurface investigation, title review, construction inspection, or prediction of future septic system performance.

The Company may submit inspection forms, reports, or inspection-related information to the applicable Board of Health, MassDEP, or other approving authority where required by law, regulation, or official procedure.

Nothing on this website is intended to avoid, delay, limit, or modify any legally required submission, notice, repair, upgrade, design, permit, review, or enforcement process.

Inspection and Service Limitations

Any inspection, evaluation, service visit, maintenance visit, consultation, or field observation is limited to the agreed scope of work, conditions observed at the time of service, components that are reasonably accessible, information provided by the client or third parties, weather and site conditions, and applicable regulatory requirements.

The Company does not guarantee or warrant:

  • future system performance;

  • remaining useful life;

  • future groundwater conditions;

  • future wastewater flow;

  • future occupancy, bedroom count, or change-of-use suitability;

  • hidden, buried, concealed, inaccessible, undocumented, or altered components;

  • subsurface conditions not directly observed;

  • accuracy of municipal, seller, buyer, owner, broker, attorney, lender, laboratory, engineer, installer, pumper, or third-party information;

  • approval by a Board of Health, MassDEP, lender, buyer, seller, attorney, broker, or other reviewing party;

  • transaction outcome, closing date, sale price, financing approval, repair cost, or future property value.

A system that appears compliant or functional at the time of inspection may later experience problems due to age, maintenance practices, misuse, increased flow, seasonal groundwater changes, unauthorized alterations, improper discharge, third-party damage, flooding, freezing, power interruption, construction activity, failed components, or other conditions beyond the Company’s control.

No Guarantee of Transaction Outcome

The Company’s role is limited to performing the agreed service and preparing applicable documentation. The Company does not guarantee that a system will pass inspection, that a property will sell, that financing will be approved, that a closing will occur, that a lender will accept a report, that a buyer or seller will proceed, that repair costs will remain within any estimate, or that a regulatory authority will approve any condition, repair, upgrade, variance, or proposed solution.

Real estate, legal, financing, negotiation, repair, engineering, permitting, and transaction decisions remain the responsibility of the client and other applicable parties.

Third-Party Reliance

Reports, forms, communications, field notes, photographs, estimates, and recommendations are prepared for the specific client, property, date, scope, and purpose identified in the applicable service documentation.

No buyer, seller, broker, attorney, lender, tenant, contractor, municipality, regulatory authority, or other third party may rely on website content, informal communications, or inspection-related materials beyond the specific purpose and limitations stated in the applicable report or written agreement.

Third parties should obtain their own legal, engineering, environmental, real estate, financing, and technical advice before making decisions.

Client Responsibility

The person requesting services represents that they have authority to request the service, authorize access to the property, provide information, communicate on behalf of the owner or authorized party, and approve the requested work.

The client is responsible for providing accurate and complete information, including property address, owner information, access instructions, number of bedrooms, occupancy, property use, known septic components, prior reports, pumping records, repair records, permits, as-built plans, wells, known failures, wet areas, backups, odors, alarms, tenant issues, hazards, and any known or suspected additional wastewater systems.

The client is responsible for providing safe, legal, and unobstructed access to all areas and components reasonably necessary to perform the requested service.

Failure to provide access, information, authorization, utilities, water service, exposed components, pumping coordination, safe conditions, or required records may result in delay, cancellation, incomplete service, additional fees, revised reporting, or limitations stated in the report.

Site Conditions and Property Disturbance

Septic inspections and wastewater evaluations may require locating, probing, opening, uncovering, or exposing system components. Reasonable inspection-related activity may cause ordinary or incidental disturbance to soil, grass, mulch, landscaping, plantings, hardscaping, irrigation systems, invisible dog fencing, low-voltage wiring, drainage features, or other site improvements.

The client is responsible for identifying and disclosing private utilities, irrigation lines, electrical lines, propane lines, low-voltage wiring, underground drains, invisible fencing, buried structures, easements, property boundaries, restricted areas, and site hazards before work begins.

The Company is not responsible for ordinary or incidental disturbance resulting from reasonable inspection-related activity, except to the extent caused by the Company’s gross negligence or willful misconduct.

Third-Party Contractors and Outside Services

The Company may coordinate with or rely upon information from third parties, including pumpers, excavators, installers, engineers, laboratories, water testing vendors, municipal officials, Boards of Health, MassDEP, real estate professionals, attorneys, lenders, property owners, tenants, buyers, sellers, and prior inspectors.

Unless expressly agreed in writing, third-party services are separate from the Company’s inspection or service fee. Third-party services may include pumping, excavation, cover removal, repair work, engineering, surveying, water testing, laboratory analysis, municipal review, title review, permitting, or construction services.

The Company is not responsible for the acts, omissions, workmanship, pricing, scheduling, availability, conclusions, delays, reports, recommendations, or damages caused by third parties.
